TERMS & CONDITIONS

1.1 The Service

Lux Car Rentalz provides luxury and exotic vehicle rentals to qualified renters in Tampa and surrounding areas. Our website lets you browse our fleet, request a quote, and book a vehicle.

1.2 Updates to These Terms

We may revise these Terms from time to time. When we do, the “Last updated” date at the top of this page will change. Continued use of our website or services after a change constitutes acceptance of the revised Terms. You are responsible for reviewing this page periodically.

1.3 Eligibility

You may book a vehicle only if you are at least 21 years of age (25 for selected exotic models), hold a valid driver license that has been continuously valid for at least one year, and are legally able to enter a binding contract. Renters must also meet the eligibility criteria of our insurance partner.

1.4 Controlling Agreement

These Terms are a public-facing summary. At vehicle pickup, you will sign a Rental Agreement that contains the complete and controlling contract for that specific rental. If anything on this page conflicts with the signed Rental Agreement, the signed Rental Agreement governs.

2.1 Quote Requests

Submitting a quote request through our site is not a confirmed booking. We will respond with availability, a price quote, and any additional requirements within the response time published on our Contact page.

2.2 Booking Confirmation

A reservation is confirmed only when (a) you have paid the required deposit or full rental cost as indicated on your quote, and (b) we have provided you with a written confirmation including pickup time, location, and vehicle.

2.3 Identity Verification

Before pickup, we may request a copy of your driver license (front and back), a selfie holding the license, and proof of personal auto insurance. Submission of these documents is a condition of the booking.

2.4 Vehicle Availability

We reserve the right to substitute a vehicle of equal or greater value if the booked vehicle becomes unavailable due to mechanical issue, accident damage, or late return by a prior renter. If no suitable substitute is available, you will receive a full refund.

3.1 Charges

You are responsible for the daily rental rate, applicable taxes, delivery or pickup fees, optional insurance, fuel charges, and any additional charges authorized by the signed Rental Agreement (including damage, cleaning, late return, traffic citations, and toll charges).

3.2 Refundable Security Deposit

A refundable security deposit is held on a major credit card at pickup. The amount varies by vehicle and is disclosed on the vehicle detail page. The deposit is released back to your card after the vehicle is returned and inspected, less any damage, cleaning, fuel, toll, or fine charges that apply.

3.3 Payment Processing

Online payments are processed by Stripe. We do not store your full card number on our servers. Currency conversion and foreign-transaction fees, if any, are determined by Stripe and your card issuer.

3.4 Cancellation & Refund Policy

Reservations may be cancelled for a full refund up to 48 hours before the scheduled pickup time. Cancellations within 48 hours of pickup may incur a fee equal to one day’s rental. No-shows forfeit the entire amount paid. Special-event or long-term bookings may have different cancellation terms, which will be disclosed at the time of booking.

4.1 Driving Standards

You agree to operate the vehicle safely, lawfully, and in accordance with all traffic laws. You are responsible for any traffic citations, parking violations, toll charges, and red- light camera fines incurred during the rental period.

4.2 Authorized Drivers

Only the renter named on the Rental Agreement and any drivers listed and approved in writing may operate the vehicle. Allowing an unauthorized driver to operate the vehicle voids insurance coverage and constitutes a material breach of these Terms.

4.3 Prohibited Uses

The vehicle may not be used to:

• Carry passengers or property for hire (ride-share, taxi, courier).
• Tow or push another vehicle or trailer.
• Race, perform stunts, or participate in any timed event.
• Engage in any illegal activity.
• Drive while under the influence of alcohol, drugs, or any impairing substance.
• Operate off-road or on unimproved surfaces.
• Leave the geographic area defined in the Rental Agreement without prior written approval.
• Carry more passengers than the vehicle is rated for.
• Smoke or vape inside the vehicle (a cleaning fee will apply).

4.4 Mileage

Each rental includes a daily mileage allowance as listed on the vehicle detail page. Excess mileage is charged at the per-mile rate disclosed in the Rental Agreement.

4.5 Fuel

The vehicle will be delivered with a full tank and must be returned with a full tank of the manufacturer’s recommended fuel grade. Refueling will be charged at our published service rate plus the actual fuel cost.

4.6 Return & Condition

You agree to return the vehicle on or before the date and time listed on the Rental Agreement, at the agreed-upon location, in the same condition (less ordinary wear and tear) as it was delivered. Late returns are charged at the published late-return rate plus any costs incurred by delaying the next reservation.

5.1 Insurance Requirement

You must provide proof of personal auto insurance with collision and comprehensive coverage that extends to rental vehicles, OR elect our supplemental insurance product at the daily rate disclosed in your quote. Vehicles will not be released without valid coverage in effect for the rental period.

5.2 Damage Responsibility

You are responsible for any damage to the vehicle during the rental, regardless of fault, up to the actual cash value of the vehicle plus loss-of-use, diminished value, and reasonable administrative fees. Damage charges are processed against the security deposit first; any excess is charged to the payment method on file.

5.3 Limitation of Our Liability

To the maximum extent permitted by law, Lux Car Rentalz is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or any vehicle, including lost profits, lost data, or substitute- transportation costs. Our total aggregate liability for any claim arising from these Terms or a rental will not exceed the total amount you paid us for the rental in question.

5.4 Indemnification

You agree to indemnify and hold Lux Car Rentalz, its owners, employees, and partners harmless from any claim, damage, loss, fine, or expense (including reasonable attorney fees) arising from your use of the vehicle, your breach of these Terms or the Rental Agreement, or your violation of any law or third-party right.

6.1 Acceptable Use

When using our website you agree not to attempt to gain unauthorized access to any part of the site, interfere with its operation, scrape content using automated tools, or submit false or misleading information through any form.

6.2 Intellectual Property

All text, graphics, photography, logos, and software on this site are owned by or licensed to Lux Car Rentalz and are protected by copyright, trademark, and other intellectual-property laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

6.3 Third-Party Links & Services

Our website may link to or integrate with third-party services (for example, payment processing, mapping, analytics). Those services are governed by their own terms and privacy policies, and we disclaim responsibility for them.

Our website and services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Lux Car Rentalz disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non- infringement. We do not warrant that the website will be uninterrupted, error-free, or free of harmful components.

We may suspend or terminate your access to our website or services, or cancel any pending booking, at our discretion if you breach these Terms, provide false information, or engage in conduct that we believe poses a risk to our fleet, staff, or other customers. Refunds in such cases, if any, are at our sole discretion and will not be issued where the cancellation results from your breach.

9.1 Governing Law

These Terms and any rental booked with us are governed by the laws of the state in which the rental originates, without regard to its conflict-of-laws principles.

9.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or a rental will first be addressed through good-faith discussion between the parties. If the dispute cannot be resolved within thirty days, it will be submitted to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, with the seat of arbitration in the state of rental origination. You and Lux Car Rentalz each waive any right to a jury trial and to participate as a plaintiff or class member in any purported class or representative proceeding.

10.1 Entire Agreement

These Terms, together with the signed Rental Agreement for any specific rental, constitute the entire agreement between you and Lux Car Rentalz regarding the subject matter and supersede all prior or contemporaneous communications.

10.2 Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.

10.3 Assignment

You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

10.4 Notices

Notices to you under these Terms may be sent to the email address you provided when you booked or requested a quote. Notices to us may be sent to hello@lux-car-rentalz.local or to the address listed on our Contact page.
